Conditions Of Carriage
Contracts of carriage are entered into with Vuda Water Taxi Pte Ltd (Vuda Water Taxi), and tickets, travel passes, and boarding passes are issued subject to these terms and conditions, which the customer, by purchasing a ticket, acknowledges having read and understood and agrees to be bound by them. Verbal promises and representations by booking agents or Vuda Water Taxi’s crew, staff, or agents will not be recognized by Vuda Water Taxi if they are inconsistent with these terms and conditions.
These Conditions of Carriage outline the terms and conditions governing the use of Vuda Water Taxi Pte Ltd’s water taxi services and island hopping tours. By making a reservation, purchasing a ticket, or boarding our vessels, you agree to adhere to and be bound by the following terms and conditions:
1. Reservations and Tickets:
All passengers are required to make reservations for our water taxi services and island hopping tours. Reservations can be made online, in person, or by phone.
Tickets must be purchased before boarding. Valid tickets include electronic or paper versions issued by Vuda Water Taxi Pte Ltd.
Reservations are subject to availability and are confirmed only upon receipt of full payment.
Vuda Water Taxi reserves the right, in the event of a booking being canceled by the customer, to charge cancellation fees in accordance with Vuda Water Taxi’s current terms and conditions.
2. Boarding and Departure:
Passengers are required to arrive at the designated boarding location at least 15 minutes before the scheduled departure time.
Vuda Water Taxi Pte Ltd reserves the right to refuse boarding to any passenger who arrives late or fails to meet our safety requirements.
The departure times for water taxi services and island hopping tours are subject to change due to weather conditions and operational considerations.
3. Passenger Safety Guidelines:
Vuda Water Taxi emphasizes the importance of taking all reasonable precautions for your safety and those under your care, especially children. This includes, but is not limited to:
- Utilizing handrails and guard rails provided around the vessel at all times.
- Ensuring children are appropriately restrained and accompanied by a responsible adult throughout the journey.
- Paying close attention to the safety briefing given by our crew at the commencement of your journey.
- Complying with crew instructions to be seated when advised or requested for any reason.
- Exercising heightened caution during adverse weather conditions or as advised by Vuda Water Taxi’s crew, staff, or agents.
Your safety and the safety of all passengers is our top priority, and we appreciate your cooperation in adhering to these guidelines. Consumption of alcohol or illegal substances on board is strictly prohibited.
Disruptive or inappropriate behavior may result in removal from the vessel without a refund.
4. Cancellations Policy:
Within 48 hours 50%, within 24 hours 100%, and No Show 100% of the fare is non-refundable.
Vuda Water Taxi Pte Ltd reserves the right to cancel or reschedule services due to adverse weather conditions or unforeseen circumstances. In such cases, passengers will be offered the option to reschedule or receive a full refund.
5. Luggage and Personal Belongings:
Each passenger is entitled to carry up to 10 kg of luggage unless a prior arrangement has been made. We kindly request passengers to inform us in advance of any special luggage requirements or additional weight allowances. Your understanding and cooperation are appreciated.
Passengers are responsible for their own luggage and personal belongings.
Vuda Water Taxi Pte Ltd is not liable for any loss or damage to passengers’ personal items during transportation.
Disclaimer of Liability:
Vuda Water Taxi shall not be held responsible for any loss, damage, or injury to luggage, personal effects, or the customer arising from, or in any way incidental to, the provision of our services, customer accommodations, or the transfer of customers and luggage between vessels, vehicles, or places of accommodation. Whether such loss, damage, or injury is alleged to be due wholly or partly to negligence, misconduct, or fault on the part of Vuda Water Taxi, its crew, staff, or agents.
Your understanding of this disclaimer is appreciated, and we encourage you to take appropriate precautions for the safety of your belongings and yourself during your journey with Vuda Water Taxi.
6. Liability and Waiver:
Water travel carries inherent risks, and passengers accept these risks when boarding our vessels.
Vuda Water Taxi Pte Ltd is not liable for any injury, loss, or damage that may occur during the water taxi or island hopping experience.
7. Schedule and Itinerary:
Itineraries for island hopping tours are subject to change based on weather conditions and other operational factors.
Passengers are encouraged to check our website or contact us for the latest information regarding schedules and itineraries.
8. Age and Health Requirements:
Children must be accompanied by a responsible adult.
Passengers with medical conditions that may affect their ability to participate should inform us in advance.
9. Weather and sea conditions:
To avoid doubt and without limiting any other term or condition of carriage, all services are subject to weather and sea conditions.
10. Defense and Liability Rights for Associated Parties:
If a legal action is initiated against a crew member, staff, or agent of Vuda Water Taxi, or a performing carrier, and the action pertains to issues covered by the contract with Vuda Water Taxi, such crew member, staff, or agent, provided they can demonstrate that their actions were conducted within the scope of their employment or agency, shall have the right to utilize the same defenses and exclusions of liability as those available to Vuda Water Taxi or the performing carrier under the terms of the contract.
11. Prohibited Items and Substances:
For the safety and comfort of all passengers and to prevent any harm to the vessel, we kindly request that passengers refrain from bringing or including in their luggage the following:
- Explosives
- Volatile spirits
- Corrosive substances
- Easily ignitable articles
- Offensive or disruptive items that may inconvenience other passengers
- Anything that poses a threat to the vessel, fellow passengers, or cargo
Your cooperation in adhering to these restrictions is greatly appreciated, as it ensures a safe and pleasant journey for all aboard Vuda Water Taxi.
12. Governing Law and Jurisdiction for the Contract:
The contract is subject to and shall be construed in accordance with the laws of Fiji, and the customer agrees to submit to the exclusive jurisdiction of the courts of that country.
No term or condition of carriage other than those set out herein will be recognised. The contract may only be varied by written agreement between Vuda Water Taxi Pte Ltd and the customer.
